Information, Declaration and Consent Form Regarding Law No. 6698 on the Protection of Personal Data and Your Rights Under This Law

As ForInvest Software and Technology Services Inc., we would like to inform you about the methods of collecting your personal data, the purposes of processing, legal grounds, and your rights within the scope of the Personal Data Protection Law enacted to protect fundamental rights and freedoms.

Explicit Consent: Consent given freely on a specific subject based on being informed,

Personal Data: Any information relating to an identified or identifiable natural person,

Processing of Personal Data: Any operation performed on personal data such as collection, recording, storage, preservation, alteration, reorganization, disclosure, transfer, acquisition, making available, classification or prevention of use, whether fully or partially automated or non-automated as part of a data recording system,

Data Processor: A natural or legal person who processes personal data on behalf of the data controller based on the authority granted by the data controller,

Data Recording System: A recording system in which personal data is structured and processed according to specific criteria,

Data Controller: A natural or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system.

Within the scope of the Law, ForInvest Software and Technology Services Inc. acts as the data controller.

Pursuant to the Personal Data Protection Law No. 6698, which entered into force on April 7, 2016, in the event that our customers share their personal data with us in order to benefit from our services, our Company, as the Data Controller, may obtain, record, store, update, reorganize, disclose, transfer, share and otherwise process personal data within the framework set out in the law.

The purposes and legal grounds for processing your personal data include: providing and maintaining our products and services in the fields of capital and money markets, securities, commodities and related instruments, derivative markets data distribution and software; recording identity, address and other necessary information to identify transaction owners; organizing all records and documents that will form the basis for transactions; and complying with information storage, reporting and notification obligations prescribed by local and international legislation and official authorities.

Your personal data will be used in billing, reporting to relevant exchanges, our sales and marketing departments, accounting operations, and in our CRM system for better service delivery. Your personal data may be collected through bilateral agreements, website, call center and similar channels, automatically or non-automatically, in written, verbal or electronic form. Your personal data may be shared with persons, institutions and organizations permitted by relevant legislation, domestic exchanges, foreign exchanges and authorities such as CMB, our affiliates, and consultants and organizations we work with.

Subject to the exceptions set forth in Article 28 of the Law, within the framework of Article 11 of the Law, you have the right to apply to our Company regarding your personal data to:

a) learn whether your personal data has been processed,
b) request information if it has been processed,
c) learn the purpose of processing and whether it is used in accordance with its purpose,
d) know the third parties to whom personal data has been transferred domestically or abroad,
e) request correction if personal data is incomplete or incorrectly processed,
f) request deletion or destruction within the framework of Article 7 of the Law,
g) request notification of the operations performed pursuant to (e) and (f) to third parties to whom data has been transferred,
h) object to a result arising against you through analysis exclusively by automated systems,
i) claim compensation for damages in case of unlawful processing.

It is possible to exercise your rights from October 7, 2016, the effective date of the regulation, and you must submit your requests related to the implementation of this Law to our Company in writing. However, if the operations to be carried out to fulfill your requests require an additional cost, our right to request the expenses to be incurred by our Company from you according to the tariff specified in Article 13 of the Law is reserved.

This information and consent form is an annex and inseparable part of any agreement signed on behalf of our company.
